VIOLATIONS

Attention Horizon Heights Condominiums Residents,

In an effort to inform all residents of the violations that are and will be enforced now and in the future, the Board of Directors has compiled the most prevalent ones that we are experiencing, so you can prepare yourself. You can find a complete list (except for local, state and federal law) on our website, horizonheightscoa.org. Go to Governing Documents; Covenants and Restrictions; then Article-9-of-the-CCRs-Restrictions. Also under Governing Documents; Board Resolutions has further restrictions.

1) Dog Poop/Dog off leash-(Covenants, Conditions & Restrictions (CC&Rs), Article 9, Use Restrictions, Section 9.11, Pets)

These are also against the Herriman City Code Title 5, Public Safety, Chapter 1 Animal

Services.

You can and will be fined by the Association along with fines from the city for non- compliance.

If the dog poop continues to be a problem, we will institute a dog DNA system. Companies that do this include, mrdogpoop.com and pooprints.com. The dog owners will absorb all expenses from these services plus fines.

2) No garbage cans outside of garage.-(Covenants, Conditions & Restrictions (CC&Rs), Article 9, Use Restrictions, Section 9.10, Unsightly Items)

3) Oil stains on driveway (or clutter) (owner responsible for cleaning)-Resolutions, HHCOA Parking and Towing Policy, Section 9, (Covenants, Conditions & Restrictions (CC&Rs), Article 4, Maintenance and Utilities, Section 4.3 Maintenance of Common Areas and Limited Common Areas, Subsection (b) Maintenance of Limited Common Area)

4) Cannot store any bicycle, skateboard, stroller, etc. in any common areas, which includes

breezeways and under stairways.  HHCOA, Resolution Number 5, Common Area Storage

5) Dented garage doors are to be repaired by owner. (Covenants, Conditions & Restrictions (CC&Rs), Article 4, Maintenance and Utilities, Section 4.1, Maintenance of Units)

6) No clutter on patios/balconies. (Covenants, Conditions & Restrictions (CC&Rs), Article 9, Use Restrictions, Section 9.10, Unsightly Items Article 4, Maintenance and Utilities, Section 4.1, Maintenance of Units and Section 4.3 Maintenance of Common Area and limited Common Area, Subsection (b), Maintenance of Limited Common Area)

7) No open flame fire sources are allowed on balconies/patios. Herriman Fire Department,

Chapter 307 of the International Fire Code.

8) Owner is responsible for cleaning out dryer vents. (Utah Code, Title 57 Real Estate, Chapter 8 Condominium Ownership Act, Section 7.2 Scope-Designation of certain areas, Number (3)).

The Association spent almost $10,000. on the installation of cages to keep out birds and other pests, but the owner is responsible for cleaning out the venting. Violations will be issued based on the visible accumulation of lint at the cages. Professional, documented cleaning will then be required.

9) Parking. Each owner is guaranteed two parking spots only. One in your garage, one in your driveway. In the near future, because the number of units far surpasses the number of available Common Area Parking spaces, each unit will be able to purchase one decal, which will allow them to park one vehicle in the Common Area (after 10pm next to the Clubhouse).
